Introduction
These terms and conditions apply to all services offered by www.bytesrack.com and its affiliated companies. BytesRack, also referenced here as the "Company," is a legally registered corporate organization. These stipulations govern all clients (designated as "Subscribers") associated with this Company, whether they are paying subscribers or individuals receiving services from BytesRack or its affiliates. By utilizing our services, you expressly consent to the terms outlined below:
Age Restrictions for Clients
Any customer placing an order through the BytesRack online platform must confirm and warrant that they are at least 18 years of age and possess the legal authority to enter into this contract.
If a customer is under 18 years old, they must immediately notify us and cancel their services. They will be barred from utilizing any further services offered by the Company.
Individuals under 18 must secure explicit permission from a parent or legal guardian to access this website and use any of our services. We disclaim all responsibility and liability for any legal complications or issues arising from a customer misrepresenting their age.
Access, Limitations, and Restrictions
Prior to being granted access to BytesRack's control panels, you must supply personal details, which we securely maintain in our database. The client is responsible for ensuring all provided information is thorough, correct, and honest. We hold the right to deny service access if we discover any inaccuracies, missing details, or falsified data. We also reserve the right to suspend or terminate your access at any moment, without a refund, if we suspect fraudulent behavior.
In accordance with these Terms and Conditions, we provide you with a limited, personal, non-exclusive, and non-transferable license to access and use our platform. Our services are strictly intended for authorized commercial and private use; any illegal application is absolutely forbidden. You must prevent any unauthorized access to or abuse of our services. We retain the right to enforce network security protocols and bandwidth restrictions. Any unauthorized use of our platform will lead to the immediate revocation of this license, and offenders may face legal action to the maximum extent permitted by law.
Know Your Customer (KYC) & Identity Verification
To ensure a trustworthy, compliant, and secure environment, BytesRack mandates a strict KYC policy.
Clients are required to submit original and accurate information, including their Full Name, Email Address, Phone Number, Physical Address, Country, and Zip/Postal Code.
If we detect fabricated or incorrect information, you will be granted a single chance to rectify and resubmit your data using biometric verification and a valid government-issued ID. We accept clients from all over the world; however, any orders made through Tor networks, Proxies, or VPNs will be automatically flagged and declined.
If you fail to supply the mandatory valid KYC information, refunds will ONLY be processed for payments completed via Mastercard, Visa, and American Express (Amex). Payments conducted via alternative gateways, Cryptocurrency, or any other non-refundable methods will not be refunded if KYC verification fails. If you intentionally leave KYC fields blank or provide fake details, your account will face a permanent ban. Any funds tied to a banned account will be locked, and refunds will not be granted under any condition.
Your personal data will never be shared, leaked, or sold to unauthorized third parties. BytesRack is completely dedicated to maintaining the confidentiality and security of your information.
Billing, Payments, Refunds, and Subscriptions
BytesRack will only begin configuring your selected services once full payment has been received. An invoice will be sent to you at least 14 days ahead of the payment deadline. Ensuring timely payment is entirely your responsibility.
If your account carries an unpaid balance for more than 24 hours, BytesRack retains the authority to suspend or cancel your services until the balance is settled in full. We accept Crypto (USDT/Bitcoin), Credit Cards, Wire Transfers, and other authorized payment methods.
BytesRack does NOT offer refunds, except in situations addressed by our Service Level Agreement (Section 11) or if a legitimate billing error is proven.
When paying via Credit Card, you assume responsibility for the automatic subscription that activates upon checkout. Payments will be automatically charged on every due date. We do not issue refunds for automated renewals. To cancel, you must use your client portal or open a support ticket before the renewal date.
For dedicated server leases, standard configuration fees are waived unless custom third-party setups necessitate them.

Copyright and Intellectual Property Rights
All content available across our network is our exclusive proprietary information. We maintain a zero-tolerance policy for copyright violations. You are not permitted to distribute, copy, transmit, or alter our website material without our express written approval. Using our services does not grant you any intellectual property or ownership rights.
Unacceptable Content and Activities
To maintain the integrity, stability, and security of our global infrastructure, we implement a rigorous Acceptable Use Policy (AUP). Utilizing our services to promote, transmit, store, or host any of the following activities or content is expressly forbidden:
- IP Spoofing & Header Forgery: Falsifying email headers, network packet headers, or IP addresses to hide traffic origins.
- Denial of Service (DDoS/DoS): Launching, aiding, or participating in network flooding or Distributed Denial of Service (DDoS) attacks.
- Malware & Command/Control (C2): Executing, distributing, or hosting malicious code such as ransomware, trojans, viruses, or running Command and Control (C2) operations.
- Network Probing & Scanning: Brute-force attacks, vulnerability probing, or unauthorized port scanning directed at our infrastructure or any third-party networks.
- Phishing & Credential Harvesting: Running identity theft schemes, fake login portals (e.g., banking, webmail, cPanel), or hosting scam websites.
- Child Sexual Abuse Material (CSAM): We have a zero-tolerance stance on the promotion, distribution, or hosting of child exploitation content. Accounts found doing so will be terminated instantly and reported to the appropriate authorities.
- Terrorism & Extremism: Material that provides instructions for creating weapons, or encourages/promotes acts of violence and terrorism.
- Human Trafficking: Any service or content that promotes or enables illegal prostitution or human trafficking.
- Illegal Substances: The promotion, distribution, or sale of illicit drugs, unlicensed prescription medicines, or related illegal goods.
- Carding & Stolen Data: The storage, distribution, or sale of compromised personal identity information, leaked databases, or stolen credit card details.
- Ponzi Schemes & HYIPs: Operating fraudulent cryptocurrency investment sites, pyramid schemes, Ponzi schemes, or High-Yield Investment Programs (HYIP).
- Fake E-commerce: Running deceptive business operations or fraudulent online shops aimed at scamming consumers.
- Unsolicited Commercial Email (UCE): Sending mass, unsolicited messages (Spam) or managing mailing lists without verifiable, explicit opt-in approval.
- Mail & SMS Bombers: Operating applications or scripts meant to flood a user's phone or inbox with overwhelming amounts of messages.
- Blacklisting: Any action that causes our IP addresses to be flagged on international anti-spam registries (such as SORBS or Spamhaus).
- Warez & Pirated Software: Distributing or hosting copyrighted files without permission, which includes cracks, keygens, or nulled scripts (e.g., nulled Windows/cPanel/WHMCS).
- Tor Exit Nodes: Running Tor exit relays, as these frequently generate massive amounts of network abuse reports.
- Open Resolvers & Proxies: Operating publicly accessible Open Proxies or unsecured Open DNS resolvers that could be exploited for amplification attacks.
If illegal files, pirated software, hacker tools, warez, illegal MP3s, or any other unlawful activities are discovered on your account, your service will be terminated instantly without warning. Additionally, BytesRack will report your activities to the relevant law enforcement agencies.
Violation Consequence: We uphold a strict, zero-tolerance stance regarding the activities listed above. We hold the right to actively monitor network traffic for any signs of abuse. If an account violates this Acceptable Use Policy, we retain the unquestionable right to permanently terminate, wipe, or suspend the offending account/server immediately, with no prior notice.
No Refund Policy: We will absolutely not issue refunds for any services canceled due to a breach of these terms. Where appropriate, law enforcement authorities will be contacted.
Be explicitly warned that this server cannot be utilized for any unauthorized, malicious, or illegal actions. If you are caught using the server for illicit purposes, it will be terminated immediately without a refund or prior warning.
We enforce a severe Zero-Tolerance rule concerning Ransomware and Dark Web activities. If the server is caught facilitating, distributing, or hosting Ransomware, Dark Web marketplaces, or Tor Exit Nodes used maliciously, the server will be seized at once. Furthermore, your full personal KYC documentation, connection history, and precise IP logs will be unconditionally handed over to local authorities and international cybercrime divisions for immediate legal action.

Unpaid Invoices & Service Suspension
If an account is overdue by more than 30 days, BytesRack reserves the right to take ownership of any colocated hardware.
We may instantly terminate or suspend your services if you violate any conditions of this contract or fail to submit payments on time. Upon termination, we hold the right to safely erase all data stored on the servers.
Upgrades and Setup Procedures
Any requested upgrades will be applied at the beginning of your subsequent billing cycle, unless you pay in full for an immediate upgrade.
Standard installations are finished within 24 hours. The provisioning time for dedicated servers may fluctuate depending on the availability of hardware.
Cancellations
Cancellations need to be submitted through an authenticated support ticket no less than 24 hours prior to the next billing deadline. By submitting a cancellation request, you accept responsibility for all charges accumulated up to the date of termination. We do not provide pro-rated refunds for cancellations made in the middle of a billing cycle.
Service Level Agreement (SLA) & Satisfaction Guarantee
We promise a network uptime of 99.99%. You may qualify for service credits if we fall short of this guarantee because of internal network issues. Setup fees are completely non-refundable. Clients experiencing technical issues must reach out to our support staff for prompt assistance.
Limitation of Liability and Data Loss
BytesRack does not perform automatic backups of customer data unless a dedicated managed backup plan is purchased. It is solely the subscriber's duty to keep independent, off-site backups of any data placed on our servers.
In no event will BytesRack, its employees, or its directors be responsible for indirect business losses, lost profits, security breaches, hardware degradation, hardware failure, or data loss resulting from the use or inability to use our platform.
Force Majeure
BytesRack cannot be held responsible for any delay or failure to fulfill its duties under this TOS if the failure is the result of events outside our reasonable control. This includes, but is not limited to, power grid collapses, widespread global internet outages, government regulations, acts of terrorism, wars, natural disasters, or acts of God.
Amendments to the Terms of Service
BytesRack retains the authority to modify these Policies and Terms at any given time. Any changes will take effect once the revised TOS is posted on our website. By continuing to use our services after modifications are made, you explicitly agree to the updated terms. If you reject the changes, you must immediately halt the use of our services and file a cancellation request.
Governing Law and Jurisdiction
These Terms of Service will be interpreted and governed according to the laws of the United States. Any conflicts or disputes connected to or arising from these Terms will be exclusively handled by the courts situated within the United States.
Strict Cryptocurrency Anti-Money Laundering (AML)
By electing to use cryptocurrency (including, but not limited to, BTC and USDT) to pay for our services, you grant explicit consent to the following Anti-Money Laundering (AML) and compliance conditions. This policy is unconditional and applies equally to all new and existing customers.
We deploy sophisticated, real-time blockchain monitoring systems for AML purposes. We strictly forbid, and will absolutely not accept, any payments that originate from or have ties to the following high-risk categories:
- Child Exploitation & Dark Operations: Entities connected to child abuse, child exploitation, drug trafficking, or terrorist financing.
- Darknet Markets & Illegal Activities: Cryptocurrency linked to dark web marketplaces or any form of illicit operations.
- Tumblers & Mixers: Funds that have been processed through a cryptocurrency mixer to obscure their transaction history, as these tools are primarily utilized for laundering money.
- Scams, Ransom, & Stolen Assets: Cryptocurrency acquired through theft, deceptive practices (scams), or blackmail and extortion (ransomware).
- Sanctioned Entities & Law Enforcement Targets: Organizations or individuals currently under international sanctions or facing judicial and legal proceedings.
- Illegitimate Exchanges: Trading platforms involved in exit scams, illegal behavior, or those that have had their assets seized by government bodies.
- Unregulated Gambling: Cryptocurrency connected to unlicensed or illegal online betting platforms.
- Terrorism Funding & Severe Threats: Entities identified as critical security risks or those associated with the financing of terrorism.
- Cryptocurrency ATMs: Funds transferred directly from loosely regulated or unregulated crypto ATM operators. These are prohibited due to the inherent dangers of cash-based money laundering and inadequate KYC (Know Your Customer) protocols.
Should our AML monitoring systems identify your incoming transaction as being linked to any of the prohibited categories detailed above, the following measures will be executed automatically, with zero exceptions:
- Permanent Confiscation of Funds: The compromised cryptocurrency will be instantly isolated and permanently frozen to safeguard our financial ecosystem.
- Strict No-Refund Guarantee: Under no circumstances will we return, credit, or refund high-risk or blacklisted assets to the sender.
- Instant Account Termination: All of your active servers, hosting plans, and associated accounts will be instantly shut down without any prior warning.
- Cancellation of Orders: Any pending or newly placed orders tied to the flagged transaction will be voided immediately.
This policy is entirely non-negotiable. By transferring cryptocurrency into our wallets, you assume total and full responsibility for the origin and history of your funds.
